aides say he has shifted his strategy and now appeal to go voters by tossing money to them on the streets. and so we could see all of it. >> shep: request granted. tonight will it help or hurt his campaign? after racy pictures of prince william and his wife hit news stands, a court takes action against the publisher. is it too late to do any good? tonight fallout from the private moment that went public. but first from fox this tuesday night, governor mitt romney says he wants to put more americans back to work so they can qualify to pay taxes. the governor responding here on fox news channel to the uproar over comments made back in may. somebody secretly recorded that event and gave the video to the liberal web site, mother jones. the video shows governor romney telling his donors the 47% of americans who support president obama, quote, are dependent upon government, believe that they are victims, believe the government has a responsibility to care for them and pay no income tax. not everybody is required to pay

federal income tax. according to the tax policy center, people who make below $26,000 a year don't pay because of their low income. others get credit because they have children. today governor romney told fox news he has no problem with some people not paying taxes. >> there are a number of retirees, members of the military and so forth who aren't paying taxes and that's as it should be. but i do believe that we should have enough jobs and enough take home pay such that people have the privilege of higher incomes that allow them to be paying taxes. i think people would like to be paying taxes. the good news is if you're doing well enough financially that you can pay a tax. >> shep: he says he was talking about just the process of campaigning when he said this at a fund-raiser back in may.

>> shep: today president obama responded. when he recorded a segment set to air tonight on the late show with david letterman. >> one of the things i've learned as president is you represent the entire country and when i meet republicans as i'm traveling around the country, they are hard work family people who care deeply about this country and my expectation is that if you want to be president, you got to work for everybody. not just for some governor romney is holding another fund-raiser and starting today, cameras are allowed. campaign carl cameron is on it, live in dallas.

this is not a reaction to the controversy, right? >> well, it is a nod to calls for greater accessibility to the candidate and transparency from the public. but no, it's not specifically as a consequence of the controversy over the remarks he made at a fund-raiser in may. in fact, plans to open up fund-raisers to the cameras were really underway last week before this whole story exploded. mr. romney did not change his tune today. very much sticking by his assertions, though he did acknowledge the language was in his words, inelegant. mr. romney also referred to the palestinian-israeli situation and suggested with some serious doubt that a two-state solution between the israelis and the palestinians can ever be reached. that too is making big headlines. watch this. palestinians have no interest whatsoever in establishing peace and that the pathway to peace is

almost unthinkable to accomplish. >> romney has said similar things to that in the past, but never quite so bluntly. mother jones, the on-line web magazine that put this out, initially has not reloosed the entire fund-raiser. >> shep: carl, republicans are now pointing to a video from 2008 of president obama. >> turn around is fair play, they hope, and perhaps it can turn the tables on president obama since romney has taken heat not just from democrats, but republicans from his remarks. in this case, it goes back to 1998, long before obama was a u.s. senator or contemplate ago presidential campaign and he was at that time talking about the economy and using the term redistribution of wealth. republicans and the romney campaign now getting prepared to put it into attack ads. watch this. do we structurerick is figuring government systems that pool resources and hence, facilitate

some redistribution because i actually believe in redistribution, at least at a certain level to make sure that everybody has got a shot. >> republicans and the romney campaign says that pretty much proves that barak obama's agendas have been designed to grow government and create greater entitlements. >> shep: governor romney says he has to win independent voters if he wants to win the white house. obviously both campaigns are trying to do that. we'll check in with undecided vote increase a key swing state coming up inside fox report. a fox urgent, 350,000 plus chicago school kids will be tomorrow heading back to the classroom. union delegates for the chicago teachers announced they have suspended their now nine-day old strike. as you know, teachers, representatives had been pushing the city to meet certain demands. among them, they didn't want salaries tied to performance evaluations and they want guarantees about job security.

the chicago mayor, rahm emanuel, called the strike illegal and asked a judge to force the teachers to go back to work. all the details of the contract have yet to be hammered out. but it does appear there is some agreement on both sides. so the teachers will go back to work as the union prepares for a final vote in the coming weeks and the kids will go back to school. steve brown is live in chicago for us tonight. steve, teachers say a lop sided decision in favor of ending the strike, yes? >> they did. that's the description we got from folks filing out of the union hall you see behind me. many with wide smiles on their faces announcing to reporters gathered outside that they were back to work, that the strike was suspended. that is the technical term. we talked with one member of the bargaining committee, somebody involved in the negotiations. even she was surprised how one sided it was. have a listen. >> oh, it's overwhelming. >> really? >> yes. i was surprised. i'll be honest with you. there was a few nos, which is good.

democracy is how it works. yeah. >> there was some give and at the same time the teachers get a three-year deal guaranteed. that's a 7% pay increase. there is no merit pay, as you pointed out. but there will be teacher evaluations, which at least 30% will be based on standardized testing, something the union did not want. >> mayor rahm emanuel ending his media silence now? >> yes. he hen been taking questions or faced the media since thursday. he's held no media events over five days, with the expectation of one on saturday. but he is speaking out and he had been bloodied by this fight. this is the first time he's battled to at least a draw and organized labor here is encouraged by that and are eager to go at him once again. shep? >> shep: steve brown in chicago, thank you. the protesters in egypt may have made a billion dollars mistake. just ahead, how the demonstrations in cairo could end up costing that country a

>> shep: al-qaeda terrorists are calling for muslims to kill more u.s. diplomats. last week militants killed the u.s. ambassador to libya and three others at our consulate in benghazi. now al-qaeda affiliate in north africa is calling for more murders. in a statement posted on the web, terrorists urge preliminaries to kill or expel representatives of the u.s. government as retaliation for that anti-islam video that went viral last week. u.s. officials have been giving conflicting information, really, about whether that video may have played a role in the murders. ed henry is live at the white house. i guess jay carney spoke out about this today. >> he did. 'cause there has been

conflicting information as you suggest. some administration officials have said look, this was not a preplanned, premeditated attack. that's the opposite, as you know, as to what the libyan president and others have suggested. u.s. intelligence sources have told fox that the u.s. government was warned by libyan officials that violence was increasing in benghazi and that the libyan government may not be able to control it. so i pressed jay carney on whether we got some kind of a warning. take a listen. >> the administration have any sort of heads up that violence was increasing specifically in libya before the attack? >> i'm not aware of any, ed. this is a matter that's under investigation in terms of what precipitated the attack, what the motivations were, what role the video played in that. >> the president taped an interview with david letterman running later tonight and he says he has a new message for the muslim world. they need to work with the u.s. to protect americans on the ground all around the world, shep. >> shep: ed, there is new

questions now about whether libyan security forces may have actually turned on the american ambassador. >> yes. these allegations have been out there since last week. you'll remember that days ago, the u.s. state department said no libyan security guards were just on the outside the perimeter of the u.s. consulate. they were not in the inner sanctum. today the state department spokeswoman walked that back and said wait. the libyan security guards were inside. take a listen. >> they were hired to provide local libyan guards who operated inside the gate doing things like operating the security access equipment, screening the cars. >> a key question remains whether or not some of those libyan security guards turned on the american ambassador and others, told the protesters where they were and that led to their death. key part of this investigation. >> shep: ed, thank you. the antes american protests that started in cairo and spread

across the middle east have reportedly stalled more than $1 billion in financial aid to egypt. last week protesters stormed the u.s. embassy in cairo, climbed a wall and tore down the american there. shortly after that, president obama said they do not consider them an ally or enemy. but it was clarified and said they're a close partner. now the "washington post" newspaper is reporting the u.s. will not give egypt a planned $1 billion worth of debt relief, at least until after the presidential election. and in addition, the united states gives egypt more than $1.5 million in annual economic and military aid. pennsylvania's highest court told a lower court judge to reconsider his decision to uphold that state's controversial voter i.d. law. the proposed law requires every voter in the battle ground state to show photo identification before casting a ballot. opponents claim the law discriminates against lower income americans, but government

officials say it would crack down against cases of election fraud. today pennsylvania supreme court ruled the lower court judge has two weeks to defend his ruling that allows the law to stand. keep in mind, other states are facing similar legal fights with election day 49 days away. a judge says arizona can immediately start enforcing the most controversial parts of its immigration law. the section that requires cops to check somebody's immigration status if the cop suspects the person for another reason and suspects he or she is in the country illegally. u.s. supreme court upheld that part of the law. but opponents challenged it on other grounds. they say they're waiting for a ruling from a federal appeals court. supporters say arizona needs that law because the feds are not doing enough to secure the borders. major ruling now on those racy pictures of prince william's wife and this ruling may be enough to have the royal couple dancing for joy. coming up, what a judge has now decided.

>> shep: a legal victory today for prince william and his wife, kate. a french court ordered a magazine publisher to happened over all the copies of those photos that show the duchess of cambridge without a shirt on. the ruling also bans the magazine from publishing them again. the photos show kate sunbathing while wearing no top. her husband, prince william, by her side. the court's ruling noted the photographer caught them on the balcony of a private home. several hundred yards from the nearest public road.

today the royals were all smiles during a stop in the south pacific. but even with the court ruling, millions of people have obviously already seen the photos, which quickly made the rounds on the internet. trace gallagher with the news. this affects only the french magazine. but there are other magazines that publish these photos. >> yeah. in fact, two other magazines have gone forward and published those topless photos of the duchess of cambridge. we're talking about the daily star from ireland, as well as key magazine in italy. that magazine is also owned by former italian prime minister sylvio berlusconi. it's also the magazine that published those controversial and disturbing pictures of princess diana after the car crash that took her life. so the royal family clearly has a personal issue with paparrazzi, but for now, magazines have very little incentive to stop. listen. >> magazines, newspapers, always do a cost benefit analysis and

they always believe it's in their interest to publish what they want to publish, go to court, defend themselves and write a check. >> in the wake of the irish magazine, printing those topless photo, now ireland is also considering strengthening their privacy laws. shep. >> shep: outside of france, the royals may have lost this court battle? >> may very well have because france has very tough privacy laws and even though that villa the royal couple was in is surrounded bay park and said to be several hundred yards from a road, well, in a lot of places, they were out on the terrace and they were in full view, to they said that makes them fair game and legal experts say in other countries, closer would be right. listen. >> in american law, even in criminal law, there is something called the plain view doctrine. if you're doing something in a place even if you think you're in private, but it is plain view to other people, then you don't have a privacy act citation.

seaboard. but that concentrated risk really along the east coast, bellmawr have a, up toward new york city. it's a quick moving system. however, we're still going to see wind gusts in excess of 60 miles per hour. the flooding threat as well. in some cases, half an inch to an inch of rain an hour. that will cause flooding concerns. by tomorrow, out of the way, and some fall-like temperatures. >> shep: ready for it. sounds good. thanks so much. i'm shepard smith. this is the fox report. this is the bottom of the hour, time fort top of the news. the "fox business" network is report ago possible cyber attack that could, they tell us, be related to islamist terror groups. it sparked outages for bank of america's enormous web site today. according to the reporting of fox business, a source close to the matter suggests the attack may be related to threats posted on the paste bin web site. that's a site that hackers often use to issue threats or brag about cyber crimes.

bank of america so far will not comment on this reported attack. but it did release a statement saying, quote, on-line banking is and has been available, although some customers may experience occasional slowness. we are working to insure full availability. is there more to it? katherine herrage live in washington. what do we know about this? it sounds like one of those attack on services sort of deals? >> that's right. according to the cyber intelligence firm, flash point partners e-mail traffic peaked after the threat was posted on-line. this warning coming from individuals claiming to be affiliated with the armed wing of hamas, palestinian sunni islamist group, web postings threatening attacks on bank of america and the new york stock exchange to retaliate fort amateurist youtube video. the posting amounted to a how to guide for cyber novices to denounce a denial of services. it did not dump or compromise

customer records. we don't know whether those responsible used the video controversy as an excuse and borrowed the name of hamas to disguise their true identities. a final point, there was no reported impact on the new york stock exchange despite that threat. >> shep: where is the f.b.i. on this? >> tonight the f.b.i. has a tight lid on the storm they're not commenting on it. a source who works intelligence on cyber attacks told me it would be highly unusual if they were not involved because a major u.s. financial institution was a target. the claimed connection is the you tube clip and services were disrupted for a period. >> shep: thank you. >> you're welcome. >> shep: just outside the u.s. consulate in northwest pakistan, protesters throwing rocks and fire balls at police, we're told. it's the latest in a wave of demonstrations that protesters say is a response to the video which mocks mohammed. a banner being ripped offment riot police firing tear gas into

the crowd. a militant group claims it was behind a suicide bombing that killed a dozen people in the afghan capitol and that the attack was also in retaliation for that video. conner powell live in kabul now. conner? >> about a dozen people were on their way to the afghan kabul airport. all employees of air charter solutions this morning when their mini bus was hit by a vehicle packed full of explosives. at least 12 people were killed, including eight employees of air charter solutions which is a small private aircraft and airline that provides services to the u.s. embassy here in kabul. eight of those dead were south african employees of that company. a taliban offshoot has claimed responsibility for the attacks, saying it was in response to that anti-islamic film. but they also say it was carried out by a 22-year-old female suicide bomber in a country where few women drive, it's even rarer to have female suicide

bombers. the group had been in negotiations with the afghan government regarding the peace deal. this is their first known attack in more than a year. >> shep: conner powell live in afghanistan. a big change in our decade-long war there that's raising questions about the exit strategy. the pentagon announced today that most u.s. and nato troops will no longer be working side by side with afghan troops. the pentagon spokesman says it's temporary. nato made the call to suspend joint operations because of those anti-american protests and because of mainly insider attacks on our coalition forces. the associated press reports the death toll from insider attacks is up more than 40% this year. today in afghanistan, a nato spokesman defended the policy shift. >> we just thought that it would be smartest on a temporary basis to reduce the amount of exposure of our troops in certain areas. so we think it's a smart thing to do. it's a temporary measure. we look forward to getting back

to full operations. >> shep: not everybody is on board. lawmakers in the united kingdom, a member of nato, say the move could seriously undermine our strategy of transitioning control to the afghans ahead of the planned withdrawal. jennifer griffin live at the pentagon. u.s. officials are down playing this whole thing, right? >> that's right. the white house is insisting that the move does not accelerate the time line for withdrawal or the removal of most combat troops in 2014. >> it doesn't affect the time line. >> i don't think that these attacks indicate that the taliban is stronger. >> our partnership with the afghan forces continues and we will continue to operate together, so our strategy remains the same. >> but the decision will affect about 100,000 front line troops. they will no longer be going out on these joint patrols, these small group patrols with their afghan partnership. >> shep: the blue on green attacks, i'm assuming, that's

the main reason for this. a lot of our guys have been dying lately. >> certainly, the main reason. three insider attacks in three days. 51 american and coalition troops murdered by afghan security forces that they had trained. >> i am fed up with watching our seriously good soldiers waste their lives, have their lives wasted by people who are meant to be our friends. >> this former british commander who now sits in the british parliament expressing the frustration that we are hearing behind the scenes at the pentagon and the basically which led to this decision to stop these joint patrols with the afghan which is is a key part of the exit strategy. >> shep: thanks. two americans who left prison in the nation of ganbia are on their way back to the united states. jesse jackson flew there to meet with the president there and secure their release. fox news can confirm the americans will be arriving in new york tomorrow with the reverend jackson. one of the prisoners wars a former university of tennessee

>> shep: the price of oil dropped today, but it was nothing compared to yesterday's free fall and most interestingly, nobody seems to know why it's happened. yesterday the cost of a barrel of crude oil fell more than $3 in less than one minute. it happened during late trading on the new york mercantile exchange. then today the price fell another dollar and change to close at 95.29. there are several theories about what might have happened, everything from price manipulation to a trader hitting the wrong button. as you know, where oil prices go, the cost of gasoline should follow, makes sense, right? triple a reports the average price for a gallon of regular unleaded held steady overnight. but still up more than ten cents from last month. gerri willis is with us.

tell us what -- do you know? >> no idea. >> shep: come on. >> i can see you now. >> shep: usually there is -- you can point to something, something that happened in the middle east or refineries or something. >> no. somebody out there knows, but it's not me. and it's not even regulators out there. you mentioned the bad finger trader. maybe a computer glitch. we have seen a lot of computerized trading problems. maybe it was intentional. maybe somebody made a trade to sell off high priced gas. who knows? even the people who run the exchanges are saying they don't know. >> shep: usually oil -- price of gas lingers by a few days, maybe there will be something. but the white house is getting involved. >> that's right. jay carney had this to say today about this problem. >> with regards to the international oil market and oil prices, we monitor them constantly with our international partners. it's something that we keep very close track of and we retain the

right to keep all option for dealing with those issues on the table. >> so everything on the table. they're watching what they can. you should know the cftc, big regulators, commodityieses are investigating this. what's more, everybody is weighing in on this. as you just heard jay carney having something to say. nobody really knows. one of the big questions in the background, is the president going to release the spr, strategic petroleum reserve? that will bring down prices. who knows? the white house just saying that maybe we will. maybe we won't. >> shep: maybe it will happen again tomorrow and the next day. >> we don't know. but maybe gas price also go down. that would be good. >> shep: very good. thank you. folks in alaska will soon get their annual share of that state's oil revenues. today we learned their checks will be a lot smaller this year. one state official revealed the grand total, $878 per person. that's a drop from more than $1,100 last year and the

smallest payout since 2005. you may know there is no state income tax on the dividend. but folks do have to give a portion to the feds. some alaskans say they'll use the cash to pay for gasoline, which in alaska, get this, costs nearly $6 a gallon in some parts of the state. people who bought stock in apple a few years ago are now up more than $600 per share. today the company stock hit another record high, closing above the $700 mark for the first time ever. compare that to about three years ago, look at this. three years ago, apple shares sold for about $90 a pop. the latest surge came on the news that demand for the iphone 5 is even higher than the analysts expected. the phone comes out this friday. apple warns it will not be able to fill some of the orders until next month. newly published e-mails show a justice department spokeswoman worked with a liberal group to challenge some media coverage of the obama administration.

specifically some of the coverage on this network. the web site, the daily caller, conservative outfit, obtained the e-mails. its editor in chief and fox news contributors, tucker carlson, is in charge. james rosen is in dc news room. hello, james. >> good evening. the department of justice turned over 69 pages of materials to the conservative web site, the daily caller. these documents obtained under the freedom of information act include multiple e-mails to and from a woman named tracy smaller. she is the director of doj's office of public affairs. and these e-mails show her corresponding with various staffers at the liberal outfit, media matters. the e-mails show she sometimes obliged meet i can't matters' requests for documents used to undermine the credibility of fox news incidents presents and obama administration critics: but also sometimes she reached out to them on her own. >> one case we have the spokesman from the justice department e-mailing media matters and saying, in effect,

why don't you do a story on this? i saw something on fox and i don't like it and why don't you attack it? i'm sure they're watching this right now. i don't think there is any question about it. >> six months ago, the e-mails show, after tea party figure appeared on fox news to advance the disputed claim that operation fast and furious was conceived to lay the ground work for tougher ground control rules, she e-mailed it to a media matters. you see this. completely false. wide receiver, two gun tracing launches under the president bush. by that afternoon, media matters' web site featured a blog post on the phillips segment. media matters is ostensibly a tax expect nonprofit devoted to exposing media bias. but its founder has characterized his group's mission as the waging of war on fox news. the justice department declined to comment for this story, a

spokesman for media matters said he would only comment if he could appear live on this network. >> shep: james rosen, thank you. hours ago the united states government honored a man who gave his life to protect the nation. the border patrol held a phony to dedicate the brian terry border patrol station in arizona. brian p terry was the agent who died in the shootout with mexican bandits. investigators linked the weapons to the gun sting that james rosen was mentioning, fast and furious. that operation was meant to track guns to mexican drug cartels, but the fed did not keep tabs on some of those weapons and the justice department's inspector general is scheduled to testify this thursday about what we want wrong. did -- we want wrong. the parents of that murdered border agent say they're still waiting for answers about why their son died. >> i want the people that murdered him and i want the people responsible for their

guns. >> shep: agent terry's family was there in arizona for the ceremony today. this was but the second time that the government has named the border patrol station after an agent. political experts have long said this election is all about the economy. but tension in the middle east has put foreign policy near the front and center if not right there. something analysts say could go a long way in swaying undecided voters. we'll talk to some of them next. voters over the past couple of days and the undecideds sound anxious about the future and worried about a whole range of issues. >> i am concerned about the economy. i'm concerned about the money. right now i feel like we're in a situation that has started for generations back not exactly confident about the economy moving forward at this point. >> national security perhaps going to go a little higher on your list of priorities? >> always for me. i'm a veteran, so yeah. yes. absolutely. >> virginia has a very large active military and veteran population. so that's not surprising. but it does seem research suggests that they have been noticing the recent violence in the middle east. shep? >> shep: we've been seeing what the polls say is important, but what other issues you have spoken with are on their minds what, 49 days until? >> they're struggling with this decision. with 13 electoral votes up for grabs, those undecideds could very well choose the winner

there. >> i'm struggling with whether i should decide based solely on my pocketbook or whether i should make a decision based on some of the social issues because i think the two parties are very, very different and i find myself leaning one way economically and the other way fort social issues. >> i'm frustrated because i get all these phone calls that i don't want. people call me from the democrat party and the republican party, wanting to know how i'm going to vote. i'm going to decide that when i get to the polls. >> if she thinks the ads and robo calls are bad now, the next seven weeks should be worse. >> shep: might as well disconnect that thing. mike, thank you. there is a new study out that projects by the end of the year 2030, more than half of the population in 39 states will be obese. not just overweight, but obese. look at all those states. the study comes from two health advocacy groups. the trust for america's health group and robertwood johnson foundation. mississippi will rank the worse
